This Act is known as the Forest (Conservation) Act, 1980. This law applies to the whole country except Jammu and Kashmir. Although, Article 370 has been revoked which means all central laws must be made applicable to the whole country. However, as of now, only 37 laws apply to Jammu and Kashmir and this Act is not included under these 37 laws. Sec. 2 of the Forest Conservation Act, 1980 shall not apply to any private plantation, orchard, bagan comprising of trees planted in any area which is not a *S.O. It was further amended in 1988. This law extends to the whole of India. It was enacted by Parliament of India to control further deforestation of Forest Areas in India. The act came into force on 25 October 1980. (1) This Act may be called the Forest (Conservation) Act, 1980 (2) It extends to the whole of India except the State of Jammu & Kashmir. The special feature of this act is that it compels a State Government to take 'prior approval' of the Government of India if it de-reservation of forests or use of forest land for non-forest purposes.
